Update: Commercial Evictions

On March 4, 2021, California Governor Newsom signs executive order which would give local governments the authority to extend the halt of commercial evictions through June 30, 2021 for those commercial tenants that have been impacted by the pandemic. AB 1199: Excise Tax on Rental Property Owners

Assembly Bill 1199 was introduced on February 18, 2021 by Assemblyman Mike Gipson which is intended to implement an annual excise tax for the privilege of renting/leasing out qualified properties. Should this Bill pass, it would take effect immediately upon the signing of Governor Newsom. COVID Relief Update

California Assembly Member David Chiu introduced a residential bill this week in hopes of extending the eviction moratorium. You may recall that earlier in the year, Governor Newsom signed AB 3088, which provided protection through January 31, 2021 to tenants who were experiencing pandemic related hardships. AB 3088: Tenant and Landlord Protection

On August 31, 2020, Governor Newsom signed AB 3088 which protects tenants from eviction due to COVID-19 related hardships through January 31, 2021. This includes related hardships accrued between March 4, 2020 – August 31, 2020 if the tenant provided a declaration of hardship within the legislation’s timeline. Update: California Rent Moratorium

The Judicial Council of California has voted 19-1 to end the state’s moratorium on foreclosures and evictions that is currently in effect through midnight on September 1st. The legislative branch; however, continues to negotiate a solution by proposing: AB 1436 which seeks to extend the rent moratorium for 15 months after the COVID-19 state of emergency terminates or until April 1, 2022, whichever is earlier.

Executive Order N-71-20

On June 30th California’s Governor Newsom signs Executive Order N-71-20 allowing rent moratoriums to be extended until September 30th.  This order also addresses the extension of several other measures in earlier orders by 60 days in response to the pandemic.
